Abstract

This book studies the historical and discursive conditions of the emergence of the “right of translation” and the right which manages it: the right of the author (copyright). Privileging a primarily archaeological approach, this book shows how the traditional conception of the translation has played a significant part in the development of legal discourse, which has contributed to the growing respect for the author and his rights such as conceived of today. The book proposes a new policy of the right to translate that does not only question copyright as a catalyst of the marketization of the intellectual production, but also questions the international right as an instrument of cultural imperialism of globalisation. The study shows how the “right of translation”, from now on not conceived of anymore in the traditional legal field, but rather in that of political resistance, becomes a “right to translation”. To translate freely is the possibility to nurture oneself with the knowledge and culture of others while preserving their identity and independence.
